Terms of Service

⚠️ Important Notice: MyShiftReminder is a notification and reminder service only. We are NOT an employer, payroll provider, time-tracking system, or human resources platform. Our service sends automated reminders — it does not verify, validate, or guarantee that employees have actually clocked in or out.

1. Acceptance of Terms

By accessing or using MyShiftReminder's services, you agree to be bound by these Terms of Service and all applicable laws. If you do not agree, please do not use our services.

2. Description of Services

MyShiftReminder provides automated shift reminder notifications including:

  • SMS text message reminders before scheduled clock-in and clock-out times
  • Automated voice call reminders before scheduled clock-in and clock-out times
  • A web-based dashboard to manage workers, schedules, and reminder preferences

MyShiftReminder is a reminder service only. We do not:

  • Track, verify, or record actual clock-in or clock-out times
  • Serve as a time and attendance system
  • Replace Electronic Visit Verification (EVV) systems
  • Provide payroll, HR, or scheduling services
  • Guarantee that workers will clock in or out on time

3. Account Responsibilities

As an account holder, you are responsible for:

  • Providing accurate worker information (names, phone numbers, schedules)
  • Obtaining consent from workers to receive automated SMS messages and/or voice calls from MyShiftReminder
  • Complying with all applicable federal, state, and local laws regarding employee communications, including the Telephone Consumer Protection Act (TCPA)
  • Maintaining the confidentiality of your account credentials
  • Removing workers promptly when they are no longer employed or no longer require reminders

4. SMS and Voice Call Communications

By adding workers to MyShiftReminder, you represent and warrant that:

  • You have obtained prior express consent from each worker to receive automated SMS messages and/or voice calls
  • Workers have been informed about the nature, frequency, and purpose of these communications
  • Workers can request removal at any time by contacting their employer

Message frequency: up to 4 messages/calls per worker per day. Message and data rates may apply. Standard carrier rates apply to all SMS messages.

Opt-Out: Workers may reply STOP to any message to stop receiving SMS reminders. The account holder will be notified and is responsible for updating the worker's status in the dashboard.

Help: Workers may reply HELP to any message. They will receive: "MyShiftReminder: Shift clock-in/out reminders from your employer. Contact your employer or email support@myshiftreminder.com for help. Reply STOP to cancel. Msg&data rates may apply."

Mobile information will never be sold, shared, or distributed to third parties or lead generators.

5. Subscriptions, Free Trial & Payments

MyShiftReminder offers a 7-day free trial. Your payment method will not be charged until the trial period ends. After 7 days, your subscription will automatically renew monthly based on the number of active workers and their selected reminder type.

Current pricing:

  • SMS Only: $3 per worker per month
  • Calls Only: $6 per worker per month
  • SMS + Calls: $8 per worker per month

Billing adjusts automatically when you add or remove workers or change their reminder type. Payments are processed securely by Stripe. MyShiftReminder does not store credit card information.

6. Cancellation & Refunds

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing cycle. To cancel, contact us at support@myshiftreminder.com. Refunds are evaluated on a case-by-case basis.

7. Service Availability

We strive to maintain 99.9% uptime. However, we do not guarantee uninterrupted service. SMS and voice call delivery depends on third-party carriers and telecommunications infrastructure beyond our control. We are not liable for delays or failures in message delivery caused by carrier issues, network outages, or recipient phone settings.

8. Limitation of Liability

To the maximum extent permitted by law, Son Healthcare Services LLC, operating as MyShiftReminder, shall not be liable for:

  • Workers failing to clock in or out despite receiving reminders
  • Payroll errors, disputes, or inaccuracies
  • Compliance violations related to time tracking, EVV, or labor law
  • Loss of revenue, data, or business opportunities
  • Delays or failures in SMS or voice call delivery
  • Any indirect, incidental, special, or consequential damages
  • Damages exceeding the amount paid to MyShiftReminder in the 30 days prior to the claim

You agree that MyShiftReminder is a supplemental reminder service and is not a substitute for proper time-tracking systems, payroll software, or workforce management solutions.

9. Indemnification

You agree to indemnify and hold harmless Son Healthcare Services LLC, its officers, employees, and agents from any claims, damages, or expenses (including attorney fees) arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your failure to obtain proper consent from workers for automated communications
  • Any TCPA or similar claims arising from messages sent through your account

10. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Philadelphia County, Pennsylvania.

11. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance of the new Terms. We will notify you of material changes by email.
